These terms govern your use of the Clayaround.com and the purchase of products or digital products from us.

You agree to use the Website lawfully and not to:

– Attempt to gain unauthorised access to the Website or its systems.

– Copy, scrape, reproduce or commercially exploit Website content without permission.
– Use the Website to infringe another person’s intellectual-property rights.
We may suspend or restrict access where reasonably necessary for security, maintenance, misuse or legal reasons.

We ensure that information on the Website is accurate and up to date. However, we do not guarantee that the Website or all content will always be complete, accurate, available or free from errors.

Prices for products may change at any time, but these changes will not affect any existing Agreement.
We make every effort to ensure that prices shown are accurate. If any inaccuracies are found we will contact you immediately. You have the option to cancel the order or to confirm that you accept the change.
Delivery Charges apply to all orders unless otherwise stated and are to be paid in advance of delivery.
If you change your mind about any purchase you have 14 days to return the goods. The goods returned must be in saleable conditon and in their original packaging. However the payment gateways are now charging fees on refunds and this will be passed onto the customer. The cost of postage is your responsibility.
NB We are not VAT registered so cannot provide VAT invoices

Unless stated otherwise, we own or are licensed to use the copyright, trade marks, designs, text, images, graphics, software and other content on the Website.
You may view and use Website content for personal or internal business purposes only. You must not reproduce, modify, distribute, sell, publish or commercially exploit it without our prior written permission.
Digital products
We may sell or provide digital products such as [tutorials through the Website.
Before ordering, the product description will explain, where relevant:
– What the product contains.
– The file format and size.
– Compatible software or devices.
– Any technical requirements.
– Whether updates or support are included.
– Any licence restrictions.
You are responsible for checking that the product is suitable for your intended use and compatible with your device or software.
Orders and payment
An order is submitted when you complete the online checkout process and select the relevant payment button.
Your order is subject to our acceptance. We may reject or cancel an order where:
– The product is unavailable.
– There is an obvious pricing or description error.
– Payment is not authorised.
– We reasonably suspect fraud or misuse.
– We cannot legally supply the product.
NB That goods are displayed is an invitation to buyers to make an offer at the price marked and is called ‘invitations to treat’. A potential buyer cannot insist that a trader should sell her/him any goods simply because they are on display.
Prices are shown on the Website and include VAT where applicable. We are NOT VAT registered.
We do not store complete payment-card details.
Delivery
Products will be processed usually within 24 hours and delivered by Royal Mail.
Where possible we use recycled packaging.
Download access
After successful payment, we will provide access to the digital product by email within 24 hours
You must not share, resell, publish or distribute a download link intended for your personal use.
If a download product is not received, contact us at Letmeknow@clayaround.com We may provide a another appropriate remedy.
Licence to use downloads
Unless the product description says otherwise, we grant you a limited, non-exclusive, non-transferable licence to use the downloaded product for personal use only.
You must not, unless we give you written permission:
– Resell, sublicense or redistribute the product.
– Upload it to a public website, file-sharing service or repository.
– Claim that you created it.
– Remove copyright, ownership or licensing notices.
– Use it to create a competing product.
– Share it with people outside the permitted user group.
Your licence ends if your purchase is refunded, cancelled or terminated under these terms.
Consumer rights and faulty downloads
If you are a consumer, your legal rights apply in addition to these terms.
Digital content should be of satisfactory quality, fit for purpose and as described. If the digital product does not meet those requirements, you may have rights to a repair or replacement and, where appropriate, a price reduction or refund. Nothing in these terms affects rights that cannot legally be excluded or limited.
Cancellation and refunds
If you are a consumer, you may normally have a 14-day cancellation period for an online contract. However, for digital content that is supplied immediately, you lose that cancellation right once your supply begins. We will obtain that confirmation during checkout where applicable.
This does not remove your legal rights if the digital product is faulty, does not match its description or otherwise fails to comply with applicable law.

Refund process
Where you are entitled to a refund, we will normally refund the original payment method within 24 hours of confirming that a refund is due.
Liability
We do not exclude or limit liability where doing so would be unlawful, including liability for:
– Death or personal injury caused by negligence.
– Fraud or fraudulent misrepresentation.
– Breach of your statutory consumer rights.
– Any other liability that cannot legally be excluded or limited.
Subject to the above, we are not responsible for losses that were not reasonably foreseeable or for business losses suffered by a consumer.

The Website may contain links to third-party websites or services. We do not control and are not responsible for their content, availability, security or privacy practices.
Your use of third-party services may be subject to their own terms.

Governing law

You do not have to have a PayPal account to pay by Paypal.
You can also pay by Stripe which is a secure payment gateway where you can use credit or debit cards. We do not take payment over the phone. We do not have access to any of your credit or debit card details.

Note If you choose to add to your order after payment, and that is agreed, then payment by Bank Transfer is the only payment that is acceptable in order to avoid payment of gateway fees.
We will accept additions to your order only if the order has not been packed ready for dispatch.
Clay
ClayAround does not guarantee that batches of clay supplied will be identical as there can be manufacturers’ variations.
The colours on this site are for guidance only as each computer screen represents them differently You may choose to contact us for advice on suitability before placing an order
The clay we stock is kept in a cool environment so is in good condition when it is sent to you. If you do not consider it is satisfactory you must return it within 30 days of purchase. Clay that has been held for longer will not be exchanged.
If you are not happy with the clay we will automatically suggest you return it, but on receipt of the clay, if we find it is easy to condition, then we will let you know. The refund will be at our discretion. The postage cost will be your responsibility, as will be the payment gateway fees if a refund is not offered.
Cernit clay is soft when newly manufactured. If too soft it should be leeched or left on the shelf for a few weeks. We do not take responsibility for the unsatisfactory results from the use of soft clay.
All orders are subject to availability. The site control system will indicate, real time, if items are temporarily unavailable (the item will not show on the shopping cart). Availability is often out of our control. Stock delivery times to us vary given that most stock comes from America and/or Europe. If you have ordered something that is not available we will contact you immediately with the option to cancel and receive a refund, or an alternative.
We cannot accept back order on items if they are out of stock. They will have to be ordered again at a later date.
